1. Introduction:
1.1. These terms and conditions govern the provision of bicycle repair and retail services by FietsSmid & KinefDesigns ("Service Provider") to the customer ("Customer").
1.2. Once the Customer agrees to a service appointment or/and bicycle purchase or/and bicycle parts/accessories purchase, they also agree to the Terms and Conditions.
2. Scope of Service:
2.1. Service Provider provides repair services for both electric and non-electric bicycles.
2.2. Service Provider has the right to decline a repair service.
2.3. The repair services include but are not limited to diagnosing, repairing and/or replacing parts on bicycles to ensure proper functionality.
3. Estimates and Quotes:
3.1. Upon diagnosis of the bicycle, the Service Provider will provide an upper and lower estimate for the repair cost and obtain consent from the Customer before proceeding with any repair work.
3.2. Any non-agreed work will be noted as a Remark in the Invoice
3.3. The diagnosis is a paid service.
3.4. Any additional work required, that appears while the approved service is ongoing, will be communicated to the Customer by the Service Provider, for approval before proceeding, due to the additional cost of the service.
3.5. The repair timeline provided by the Service Provider is an estimate and may vary depending on the availability of parts, the complexity of the repair and force majeure (natural disasters, governmental restrictions, war, civil unrest, riots, strikes, transportation disruptions, etc.).
4. Use of Customer Bicycles for Social Media & Commercial Purposes:
4.1. By using our services, you agree that we may take and use photographs or videos of your bicycle for social media, promotional, and commercial purposes. These images may be shared on our website, social media platforms, advertisements, or other marketing materials.
4.2. If we wish to feature you along with your bicycle in any such content, we will first obtain your verbal consent. Only after your agreement will we post any images or videos that include you personally.
5. Customer Responsibilities:
5.1. Customers must provide accurate information about the bicycle's condition and any issues they are experiencing, failing to do so will set off clause 5.3.
5.2. Customers are responsible for providing access to the bicycle for repair at the scheduled appointment time.
5.3. Customers are responsible for any additional costs incurred due to changes in the repair scope or requirements beyond the initial quote.
5.4. Customers are responsible for successful payment of the Invoice.
5.5. Customers are responsible for removing any bicycle accessories not original to the bicycle, since this can obstruct the repair, failing to do so will incur additional costs.
6. Service Provider Responsibilities:
6.1. The Service Provider is responsible for ensuring quality of their labor.
6.2. The Service Provider is responsible for informing the Customer on the best care/maintenance of their bicycle.
7. Charges and Payments:
7.1. The Customer agrees to pay the charges for the services as outlined in the Invoice.
7.2. Payment for bicycle repair services is due upon completion of the repair work.
7.3. Payment for a purchased bicycle must be completed in full prior to delivery.
7.4. The Service Provider accepts only bank transfer payment methods.
7.5. Successful payment is considered a received bank transfer by the Customer, to the Service Provider bank account, specified in the Invoice.
7.6. The Service Provider has the right to keep the Customs bicycle in their possession until the Customer pays for the repair service.
7.7. Late payment may incur additional charges, due to bike storage fees.
7.8. Bike storage fees (5€/day) are incurred on the initial Invoice after 15days, from the Invoice delivery date, with a maximum storage period of 90days.
7.9. After maximum storage period is exceeded, the Service Provider reserves the right to the ownership of the Customer serviced bicycle.
8.Orders:
8.1. Bicycle purchasing orders are only performed in person between the Customer and Service provider at the business location of the Service provider.
8.1.1. Current location: Hurksestraat 19, 5652AH, Eindhoven, The Netherlands.
9.Delivery:
9.1. Bicycle deliveries from Service Provider to Customer, or vice versa, shall be performed at the Service Provider business location.
9.2. Service Provider does not provide a delivery service.
9.3. Bicycle deliveries can and may be affected by force majeure, which can lead to delayed deliveries and/or cancellation of the order without compensation.
10.Returns:
10.1. Products purchased in-store are non-returnable, except in cases where they are found to be defective or not as described. Customers are encouraged to inspect bicycles before purchase. In the event of a defect, the customer is entitled to remedies as per the EU legal guarantee (repair, replacement, or refund, depending on the situation).
11.Warranty:
11.1. The Service Provider provides a warranty on the labor for a period of 30days from the Invoice payment. The 30th day included.
11.2. Any parts provided by the Service Provider are excluded from the warranty due to their respective manufacturers' warranties:
11.2.1. Any other bicycle part (chain and/or belt, hubs, gears, sprockets, pedals, disk brakes, brake pads, calipers, brake lines, brake leavers, brake fluid, seats, seat posts, handlebars, rims, rim spokes, tires, mud guards, carriers (front or rear), lights (front or rear), GPS trackers, displays, buttons) is considered wear and tear part.
11.3. The warranty does not cover damage resulting from misuse, accidents, normal wear and tear, or defects due to incorrect maintenance.*
11.4. If a serviced part is returned within the warranty period, the original warranty period (described in clause 11.1 and 11.2) also remains in force on this replaced part ("no warranty on warranty").
11.5. If a serviced part is returned within the warranty period, the original warranty period (described in clause 11.2) is dependent on the manufacturer's decision.
11.6. If a serviced part is returned within the warranty period, the Service Provider shall perform free of charge diagnosis to ensure that issue is within warranty.
11.7. If a serviced part is returned within the warranty period, and the Service Provider proves in detail the damaged part fulfills clause 11.3, the diagnosis is not free of charge.
11.8. If a serviced part is returned within the warranty period, a maximum of one additional free of charge diagnosis will be provided.

12. Liability:
12.1. The Service Provider shall not be liable for any damage or loss arising from the use of the bicycle.
12.2. The Customer is responsible for ensuring that the bicycle is in proper working order before use.
12.3. If only a single part has been serviced, without the rest of the bicycle being diagnosed, The Service Provider is not liable for additional issues within a bicycle and/or damage to the serviced part.
12.4. If the Customer bicycle is serviced at another third-party service provider, the Service Provider mentioned in this document is not liable for any damage incurred on the serviced part at a later stage.
12.5. Customers are responsible for ensuring that their bicycle meets all safety standards and regulations after repairs are carried out.
12.6. Customers are responsible for any damage incurred on a demo/occasions bicycle during a test ride or/and their own negligence while browsing in the bike store premises.
13. Cancellation and Rescheduling:
13.1. Customers may cancel or reschedule their repair appointment up to 24 hours prior to the scheduled appointment time without incurring any fees.
13.2. Cancellation after the commencement of work may incur charges for labor and materials already expended.
14. Confidentiality:
14.1. The Service Provider agrees to keep any personal or confidential information provided by the Customer confidential and will not disclose it to third parties when possible.
15. Governing Law:
15.1. These terms and conditions are governed by Dutch law.
15.2. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts in the East Brabant court, Eindhoven location.
16. Amendments:
16.1. The Service Provider reserves the right to amend these terms and conditions at any time.
16.2. Customers will be notified of any changes, and continued use of the services constitutes acceptance of the amended terms.
By engaging with our bicycle repair services, you acknowledge that you have read, understood, and agreed to abide by these terms and conditions.

Appendix
1. Recommended Usage Guidelines
To ensure the best user experience, maximize the lifespan of the bicycle, and minimize wear and tear, the Business recommends the following usage guidelines. The Customer agrees to adhere to these guidelines as a condition of the warranty:
a. Regular Maintenance:
i. Perform regular maintenance checks (e.g.: tightening bolts, adjusting brakes, lubricating the chain, and ensuring all components are functioning properly.)
ii. Maintenance should be conducted at least once a year or every 1000km.
b. Proper Storage:
i. Store the bicycle indoors (house, garage or shed) to protect it from weather damage.
ii. Exposure to harsh conditions can cause electronics failures (e.g.: speed up battery degradation)
c. Proper Charging:
i. Charge bicycle only while indoors, after 60min to 120min, so the battery has had enough time to acclimate to room temperature.
ii. Initiation of charging cycle shall be as follows:
1. Insert the charger plug in bicycle charge port.
2. Insert the charger mains plug in the wall socket.
iii. The end of charging cycle shall be as follows:
1. Insert the charger plug in the bicycle charge port.
2. Insert the charger mains plug in the wall socket.
d. Appropriate Use:
i. Use the bicycle only on recommended terrains (e.g., city streets, paved paths) and avoid off-road.
ii. Avoid excessive loads (e.g.: carrying a second person on the frame, or any other load heavier than the maximum carrying capacity of a carrier (if installed)).
iii. Avoid extreme conditions (e.g.: constant BOOST application).
iv. Excessive handlebar turning can lead to internal component damage.
v. Applying torque during gear shift can cause internal damage to automated gear shifter.
e. Tire Pressure:
i. Keep tires inflated to the recommended pressure levels as specified on the tire sidewalls.
f. Safe Riding Practices:
i. Avoid excessive speed, reckless riding, or any other behavior that could lead to undue stress on the bicycle components. Always adhere to local traffic laws and safety guidelines.
